1. Acceptance of Terms

By downloading, installing, or using The First Forty Days application (the “App”), you agree to be bound by these Terms of Service (“Terms”). The App is operated by Analog Tech Ltd, a company registered in New Zealand. If you do not agree to these Terms, do not use the App.

2. Description of Service

The First Forty Days is a postpartum support application that provides:

  • Evidence-based postpartum recovery guidance and information
  • Meal coordination and dietary sharing tools
  • Visit scheduling and gatekeeper functionality
  • Task management for support networks
  • Wellbeing tracking and self-care resources
  • Shareable family status pages

3. Medical Disclaimer

The App is not a medical device and does not provide medical advice. All content is for informational and educational purposes only. The information provided should not be used as a substitute for professional medical advice, diagnosis, or treatment.

Always seek the advice of your physician, midwife, or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read or accessed through the App.

If you or someone you know is experiencing a medical emergency, call emergency services immediately.

4. In-App Purchases

The App offers a one-time premium purchase that unlocks additional features. All purchases are processed through the Apple App Store and are subject to Apple’s terms and conditions.

  • Prices are displayed in your local currency within the App
  • Purchases are non-refundable except as required by applicable law or Apple’s refund policies
  • Premium features are tied to your Apple ID and can be restored on any device signed into the same Apple ID

5. User Conduct

You agree not to:

  • Use the App for any unlawful purpose
  • Share invite codes publicly or with people outside your intended support network
  • Attempt to access other families’ data
  • Reverse engineer, decompile, or disassemble the App
  • Use the App to transmit harmful, offensive, or inappropriate content through shared fields (notes, task names, etc.)

6. Intellectual Property

All content, features, and functionality of the App — including but not limited to text, graphics, logos, icons, audio, and software — are the exclusive property of Analog Tech Ltd and are protected by New Zealand and international copyright, trademark, and other intellectual property laws.

7. Limitation of Liability

To the maximum extent permitted by New Zealand law, Analog Tech Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or personal injury, arising out of or relating to your use of the App.

Without limiting the foregoing, the App is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Indemnification

You agree to indemnify and hold harmless Analog Tech Ltd, its directors, officers, and employees from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

9. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of New Zealand.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the “Last updated” date. Your continued use of the App after changes constitutes acceptance of the revised Terms.
